989 Records Mastering Services – Terms of Service

Welcome to 989 Records Mastering Services. By using our services, submitting audio files, or placing an order, you agree to be bound by these Terms of Service. Please read them carefully.


1. Service Provider

989 Records is operated by Max Porcelli, a Steinberg Certified Trainer with over 30 years of experience in audio engineering and music production.

2. Services Offered

989 Records provides professional audio mastering services, including but not limited to:

  • Stereo Mastering: Processing of a single stereo audio file
  • Stem Mastering: Processing of up to 12 individual stereo stems
  • EP Mastering: Mastering of up to 6 tracks
  • Album Mastering: Mastering of up to 10 tracks
  • Complimentary Services: Free pre-mastering mix analysis, audio editing, mixing advice, and up to 2 revisions per track

All services are performed manually by experienced engineers using professional analog and digital equipment.


3. Ordering Process

3.1 Submitting Files

Clients must submit audio files according to our specifications:

  • Format: WAV or AIFF (lossless formats only)
  • Sample Rate: 44.1 kHz or 48 kHz
  • Bit Depth: 24-bit
  • Delivery Method: WeTransfer, Google Drive, Dropbox, or other approved file-sharing services

3.2 Order Confirmation

Upon receipt of your files and project details, we will:

  1. Review your submission for technical quality
  2. Provide a formal quote (if not standard pricing)
  3. Confirm the estimated delivery date
  4. Request payment before work begins

3.3 Payment Terms

  • Payment must be received in full before mastering work commences
  • Accepted payment methods: PayPal, Bank Transfer
  • All prices are listed in EUR (€) with USD ($) equivalents for reference
  • Prices do not include applicable taxes (VAT, sales tax) unless otherwise stated

4. Turnaround Times

Standard turnaround times are as follows:

Service Type Estimated Delivery
Single Stereo Track 1–3 business days
Single Stem Track (up to 12 stems) 2–4 business days
EP (up to 6 tracks) 5–7 business days
Album (up to 10 tracks) 7–10 business days

Business Days: Monday through Friday, excluding public holidays in Italy and major international holidays.

Rush Service: Available upon request for an additional fee. Contact us for availability and pricing.

Delays: While we strive to meet all deadlines, turnaround times are estimates. Delays may occur due to technical issues, file problems, or unforeseen circumstances. We will notify you immediately if delays are expected.


5. Revisions & Modifications

5.1 Included Revisions

Each track includes up to 2 free revisions. Revisions may include adjustments to:

  • Overall loudness (LUFS targets)
  • Tonal balance (EQ adjustments)
  • Stereo width
  • Compression and dynamics

5.2 Revision Requests

Revision requests must be submitted within 14 days of receiving your mastered files. After this period, additional fees may apply.

To request a revision, provide:

  • Specific feedback (e.g., “Increase bass frequencies around 80 Hz,” “Reduce overall loudness by 1 LUFS”)
  • Reference tracks (if applicable)
  • Comparison notes

5.3 Additional Revisions

Revisions beyond the included two free rounds will incur an additional fee, as specified on our Mastering Services page

5.4 Limitations

Revisions are intended for adjustments to the mastering process. Requests that require changes to the original mix (e.g., “make vocals louder,” “add more reverb to drums”) cannot be addressed through mastering and may require re-mixing and re-submission.


6. File Delivery & Ownership

6.1 Delivery Format

Mastered files will be delivered in the following formats (unless otherwise requested):

  • WAV (24-bit / 44.1 kHz or 48 kHz) – High-resolution master
  • WAV (16-bit / 44.1 kHz) – CD-quality master
  • MP3 (320 kbps) – Optional, upon request

Files will be delivered via secure download link (WeTransfer, Google Drive, Dropbox, or similar).

6.2 File Retention

We retain all project files (source files, session data, mastered files) for 90 days after delivery. After this period, files may be permanently deleted. If you require archival storage beyond 90 days, please contact us for extended storage options.

6.3 Intellectual Property

You retain full ownership of your music and masters. 989 Records does not claim any rights to your compositions, recordings, or mastered files.

989 Records retains the right to:

  • Use brief excerpts (30 seconds or less) of your mastered tracks for promotional purposes (portfolio, social media, website) unless you explicitly opt out
  • List your project in our portfolio or credits (artist name and track title only)

If you do not wish your work to be used for promotional purposes, please notify us in writing at the time of order.


7. Client Responsibilities

7.1 File Quality

You are responsible for providing:

  • High-quality source files free from digital clipping, distortion, or technical errors
  • Properly mixed tracks with adequate headroom (3–6 dB below 0 dBFS recommended)
  • Accurate metadata (track titles, artist names, ISRC codes if applicable)

7.2 Rights & Licensing

By submitting files to 989 Records, you confirm that:

  • You own the copyright to the submitted material, or have obtained all necessary licenses and permissions
  • You have the legal right to authorize mastering and distribution of the material
  • The material does not infringe on any third-party copyrights, trademarks, or other intellectual property rights

989 Records is not responsible for copyright infringement or legal disputes arising from client-submitted material.

7.3 Communication

Clients must provide:

  • A valid email address for project updates and file delivery
  • Clear project instructions, references, and revision feedback
  • Timely responses to questions or clarification requests

Failure to respond within 7 days to project-related inquiries may result in project cancellation without refund.


8. Refund & Cancellation Policy

Summary:

  • Pre-Production Cancellations: Full refund if cancellation occurs before work begins
  • Post-Delivery Refunds: Available only if we fail to meet agreed-upon specifications after 2 included revisions
  • Satisfaction Guarantee: If you’re not happy with the final result after revisions, we’ll work with you to make it right

9. Limitation of Liability

9.1 Service Limitations

989 Records provides mastering services to enhance audio quality. However:

  • We cannot “fix” poorly recorded or mixed tracks through mastering alone
  • Results depend heavily on the quality of the source material provided
  • Mastering cannot add instruments, vocals, or elements not present in the original mix

9.2 Technical Issues

While we use professional equipment and maintain rigorous quality control:

  • We are not liable for technical failures, data loss, or corruption beyond our control
  • Clients are responsible for maintaining backup copies of all source files
  • We recommend keeping backups of all delivered masters

9.3 Maximum Liability

In no event shall 989 Records’ total liability exceed the amount paid for the specific service in question.

9.4 Consequential Damages

989 Records is not liable for:

  • Lost profits, revenue, or business opportunities
  • Missed release deadlines or distribution schedules
  • Indirect, incidental, or consequential damages of any kind

10. Confidentiality & Privacy

10.1 File Security

All client files are:

  • Transferred via secure, encrypted connections
  • Stored on password-protected, secure servers
  • Accessed only by authorized 989 Records personnel
  • Deleted after the 90-day retention period (unless archival storage is requested)

10.2 Privacy Compliance

989 Records complies with:

  • GDPR (General Data Protection Regulation) – for EU clients
  • CCPA (California Consumer Privacy Act) – for California, USA clients
  • All applicable international data protection laws

We collect and process only the personal data necessary to provide our services (name, email, billing address, payment information).

10.3 Confidentiality

We will not:

  • Share, distribute, or sell your music without explicit permission
  • Disclose project details, client names, or sensitive information to third parties
  • Use your audio for purposes other than providing mastering services (except promotional use as outlined in Section 6.3, which you may opt out of)

11. Dispute Resolution

11.1 Good Faith Resolution

If any dispute arises regarding our services, we encourage clients to contact us directly at [insert email]. We will make every reasonable effort to resolve issues amicably.

11.2 Mediation

If direct resolution fails, both parties agree to attempt mediation before pursuing legal action.

11.3 Governing Law

These Terms of Service are governed by the laws of Italy, Jurisdiction of Pordenone. Any legal proceedings must be conducted in the appropriate courts of that jurisdiction.


12. Changes to Terms of Service

989 Records reserves the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the updated terms.

Notification: We will make reasonable efforts to notify clients of significant changes via email or website announcement.


13. Force Majeure

989 Records is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or public health emergencies
  • Government actions, war, or terrorism
  • Internet or telecommunications failures
  • Power outages or equipment failure

In such cases, we will notify affected clients and work to resume services as quickly as possible.


14. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund & Revision Policy, constitute the entire agreement between you and 989 Records regarding the use of our services.
