Licence Agreement

This Licence Agreement governs your use of every sound, sample pack, preset and software product distributed by 989 Sounds, the sound library division of 989 Records di Porcelli Massimiliano (VAT IT01593870932), trading as 989 Records. It applies to paid products and to free downloads alike, including the free sample packs offered on this website.

1. What you are buying

You are buying a licence to use the sounds. You are not buying the sounds themselves. 989 Records retains ownership and copyright of all audio content, presets and software it distributes.

2. What the licence allows

The licence is royalty-free, worldwide, non-exclusive and perpetual. Once you have paid, there is nothing more to pay, ever, and no reporting to file. You may:

• Use the sounds in your own musical works, commercial or otherwise, with no limit on the number of releases or copies sold.
• Release those works on any platform: streaming services, digital stores, vinyl, CD, or your own website.
• Use the sounds in film, television, advertising, video games, podcasts and other audiovisual productions.
• Perform works containing the sounds live, and use them in DJ sets and radio broadcasts.
• Use the sounds in beats, instrumentals or productions you create for paying clients, provided the sounds remain part of a finished musical work.
• Modify, process, pitch, time-stretch, layer and resample the material freely.

No credit is required. It is welcome, but never mandatory.

3. What the licence does not allow

• You may not redistribute, resell, licence, lend or give away the sounds in their original form, whether individually or as a collection, whether for payment or for free.
• You may not include the sounds, modified or unmodified, in any sample pack, sound library, preset bank, loop collection or similar product intended for other producers.
• You may not upload the sounds as standalone audio to any sample platform, stock audio service, file sharing service or subscription library.
• You may not register isolated sounds, loops or unaltered arrangements with any content identification system, including Content ID, or claim exclusive rights over them. You may register your own finished works; you may not claim the source material.
• You may not use the sounds to train, fine-tune or otherwise develop machine learning or generative audio models.
• You may not share your account, download links or files with other people. The licence is granted to one individual or one legal entity.

4. A note on exclusivity

These sounds are licensed to many producers. The licence gives you the right to use them; it does not make them yours alone, and it does not prevent another customer from using the same sound in their own work. Where a product is sold in a limited edition, this is stated explicitly on its product page.

5. Free downloads

Free sample packs are covered by this same Licence Agreement in full. Free of charge does not mean free of terms: everything permitted and prohibited above applies identically.

6. Software products

Where the product is software, such as an audio plugin, the licence additionally permits installation on the computers you personally use, for your own work. It does not permit installation for use by other people, distribution of the installer, reverse engineering, or circumvention of any licensing mechanism. Any audio you create with the software is entirely yours and is not covered by any further obligation.

7. Transfer and resale

This licence is personal and cannot be transferred, sold or sublicensed. If you are acquiring products on behalf of a company, the company is the licensee and the licence covers its employees acting within their duties.

8. Termination

The licence terminates automatically if you breach these terms. On termination you must stop using the material and delete your copies. Musical works you released lawfully before termination remain unaffected: you will not be asked to withdraw records already published.

9. No warranty

The material is provided as it is. We take care over what we release, but we cannot guarantee it will suit any particular purpose, and we are not liable for indirect or consequential loss arising from its use.

10. Governing law

This agreement is governed by Italian law. Nothing here limits the rights that consumer protection law grants you in your country of residence.

11. Questions
