Store Terms of Sale

These Terms of Sale govern purchases of digital products from the 989 Sounds store on this website. They do not apply to our mastering services, which are governed by their own Terms of Service.

1. Who you are dealing with

The products are created and published by 989 Records di Porcelli Massimiliano, VAT IT01593870932, trading as 989 Records, Via Tiburzio Donadon 8, 33170 Pordenone (PN), Italy. Contact: info@989records.com.

2. Who sells you the product

Orders are processed by Paddle.com Market Ltd, which acts as the authorised reseller and merchant of record for every purchase made in this store. This means Paddle, not 989 Records, is the seller of record on your transaction: Paddle takes the payment, applies and remits the VAT or sales tax due in your country, and issues your invoice. Your purchase is therefore also subject to Paddle’s own buyer terms, presented to you at checkout.

We remain responsible for the products themselves, for delivering them to you and for supporting you if something goes wrong.

3. What you are buying

Everything sold in this store is a digital product: downloadable audio files, presets, or software. Nothing physical is shipped. Each product page states what the product contains, in exact numbers rather than approximations: how many loops, how many one-shots, the file format, the bit depth and the sample rate.

Your use of the material is governed by our Licence Agreement, which you should read before buying. Buying a product means accepting that licence.

4. Prices

Prices are shown on each product page. Taxes are calculated and displayed by Paddle at checkout according to your country. The price you see at checkout, before you confirm, is the price you pay.

We do not inflate list prices in order to advertise a discount against them. When a product is on sale, the discount is real, it is applied against the ordinary selling price, and it has a stated end date.

5. Delivery

Delivery is immediate and by download. After your payment is confirmed you receive an email containing a link to your download area on this website, where your purchases remain available for you to download again.

Download links are generated at the moment you click them and expire shortly afterwards, for security reasons. If a link has expired, return to your download area and request a new one. If you have not received your email within a few minutes, check your spam folder first, then write to us and we will sort it out.

6. Your account

To access your downloads and your order history you need an account on this website. You are responsible for keeping your password to yourself. Accounts are personal: sharing an account so that other people can download your purchases is a breach of the Licence Agreement.

7. Refunds

Refunds are covered by our Refund Policy. Please read it before purchasing: because these are digital products delivered instantly, the rules differ from those that apply to physical goods.

8. Technical requirements

Audio products are supplied as standard uncompressed audio files and work in any digital audio workstation that reads them. Preset and software products state their requirements on the product page, including the host software or operating systems supported. It is your responsibility to check that a product is compatible with your setup before purchasing. Where a free trial or demo is offered, we encourage you to use it.

9. Availability and changes

We may add, withdraw or update products at any time. If a product you own is updated, you get the update at no cost through your download area. Withdrawing a product from sale does not affect your licence to keep using what you already bought.

10. Our responsibility

We take reasonable care in producing and describing our products, but we cannot promise they will meet every expectation or work in every environment. To the extent permitted by law, our liability in connection with a purchase is limited to the amount you paid for the product concerned. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Acceptable conduct

We may refuse or cancel an order, and close an account, where we have reasonable grounds to believe that the Licence Agreement is being breached, that payment details are being used fraudulently, or that our material is being redistributed.

12. Governing law and disputes

These terms are governed by Italian law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings there. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.

13. Free products and the newsletter

Some products in this store are offered for free. Downloading a free product is conditional on providing a working email address: completing a free order subscribes you automatically to the newsletter list for that product, so we can tell you when it is updated. That is how we keep free products free — a fair exchange, not a sale.

We check the email address you give us to filter out disposable or temporary addresses: free products are not available to an address created only to get around this.

You can unsubscribe at any time, for free, from the link in every email we send, or from your subscriber profile at 989records.com/newsletter-profile/. Unsubscribing does not affect your right to keep using anything you already downloaded.

14. Changes to these terms

We may update these terms. The version that applies to your purchase is the one published at the time you place your order, and the date at the top of this page tells you when it last changed.
